Is the Will valid?
Claims relating to the validity of Wills are increasing. In part this is because of home-made Wills and DIY Will packages. We are able to challenge a disputed Will and seek to have it declared invalid for many reasons, some of which include:
- The person making the Will did so because of the undue influence of another person
- The person making the Will was not of sound mind or aware of the meaning of the Will or what they were signing
- The person making the Will was under 18 years of age
- It was not properly signed in the presence of two witnesses who also signed at the same time
- A witness to the signing of the Will was also a beneficiary; in this example the Will remains valid but the witness/beneficiary loses their inheritance.
